UCITS Management Companies are subject to the regulatory requirements that derive from Irish and European legislation.

Capital Requirements

UCITS Management Companies are required to hold certain levels of capital.  The level of capital required is outlined in the European Communities (Undertakings for Collective Investment in Transferable Securities) Regulations 2011 ('the UCITS Regulations') and the Central Bank (Supervision and Enforcement) Act 2013 (Section 48(1)) (Undertakings for Collective Investment in Transferable Securities) Regulations 2015 ('the CBI UCITS Regulations'). 

UCITS Management Companies are required to hold the minimum level of capital as calculated in accordance with Regulation 17 of the UCITS Regulations and Regulation 96 of the CBI UCITS Regulations at all times and are required to submit capital returns to the Central Bank on a periodic basis.
