Legislation for Consumer Protection

Legislation relevant to the Central Bank of Ireland’s role in relation to the protection of consumers of financial services includes:

The Life Assurance (Provision of Information) (Amendment) Regulations 2017 amend Regulation 7 of the Life Assurance (Provision of Information) Regulations 2001 due to the coming into effect of the EU Regulation on key information documents for packaged retail and insurance-based investment products (the PRIIPs Regulation) on 1 January 2018. The Statutory Instrument disapplies Regulation 7(2) of the Life Assurance (Provision of Information) Regulations 2001 for products that also fall within the scope of the PRIIPs Regulation.

The Non-life Insurance (Provision of Information) (Amendment) Regulations 2021 (S.I. No 436 of 2021) came into effect on 1 September 2021. These Regulations amend the Non-life Insurance (Provision of Information) Regulations 2007 to remove the requirement to provide the previous year’s premium on renewal of a private motor insurance policy. This amendment is necessary as the Consumer Insurance Contracts Act 2019 introduced a requirement to provide the previous five years’ premium on renewal of a non-life insurance policy with effect from 1 September 2021.

This list is not exhaustive, it is the responsibility of regulated financial service providers to be aware of and ensure compliance with all aspects of applicable legislation. Where legislation has been amended, the above references are to that legislation as amended. Additional legislation which may be relevant to Central Bank of Ireland’s role in respect of consumer protection is listed in Schedule 2 to the Central Bank Act 1942 (as amended).
