ESMA Guidelines and Recommendations

On 10 October 2016, ESMA published a Final Report  on Guidelines on transaction reporting, order record keeping and clock synchronisation under MiFID II. The Guidelines aim to provide guidance on how to fill transaction reports and comply with record  keeping or clock synchronisation obligations. This document also contains the summary of responses received to the Consultation Paper issued in December 2015.  As per the ESMA website, it should be noted that the regulatory technical standard (RTS) on the reporting of transactions to competent authorities is still under the scrutiny of the European Parliament and Council, thus the publication by ESMA of the Guidelines is without prejudice to the possible objection to that RTS.
