PRIIPs KID
PRIIPs Key Investor Document (PRIIPs KID) Filing Requirements for UCITS seeking authorisation from 1 January 2023:
For a new UCITS umbrella or sub fund that is applying for authorisation from 1 January 2023 and is required to produce a PRIIPs KID, the PRIIPs KID should be submitted to the Central Bank.
The submission of the PRIIPs KIID for new umbrellas should be made by email on authorisation day with the other authorisation documents to: [email protected].
PRIIPs KID Filing Requirements for UCITS authorised prior to 1 January 2023:
UCITS authorised prior to 1 January 2023 that are required to produce a PRIIPs KID can make their initial submission of the KID through the Portal under the section “Investment Funds – Ad Hoc returns” from 1 January 2024.
Please note that the PRIIPs KID Return will not be a scheduled return on the Portal and is set up as an Ad Hoc return. It is the responsibility of the UCITS to be aware of and comply with its regulatory reporting obligations in respect to the initial filing and the submission of any subsequent amendments to the PRIIPs KID to the Central Bank.
PRIIPs KID Filing Requirements for Alternative Investment Funds:
Authorised Alternative Investment Funds that are required to produce a PRIIPs KID can submit their KID through the Portal under the section “Investment Funds- Ad Hoc returns” from 1 January 2024.
Please note that the PRIIPs KID Return will not be a scheduled return on the Portal and is set up as an Ad Hoc return. It is the responsibility of the fund to be aware of and comply with its regulatory reporting obligations in respect to the initial filing and the submission of any subsequent amendments to the PRIIPs KID to the Central Bank.
The PRIIPs KID and a written declaration as set out below should be submitted to the Central Bank.
The PRIIPs KID and written declaration will form part of the authorisation documents and should be submitted by the responsible person of the fund prior to the authorisation of a new fund or sub-fund.
The declaration must meet all of the following requirements:
(a) be signed by the responsible person or legal advisor;
(b) confirm that the PRIIPs KID complies in full with the requirements of;
- PRIIPs Regulation (EU) No. 1286/2014; and,
- Delegated PRIIPs Regulation (EU) 2021/2268
(c) confirm that the PRIIPs KID does not conflict with the content of the prospectus.
Submission of an Amended PRIIPs KID:
Where a PRIIPs KID that has been previously submitted to the Central Bank is updated, the amended PRIIPs KID should be submitted to the Central Bank through the Portal.
Interaction with the UCITS KIID:
Where a UCITS produces both a UCITS KIID and PRIIPs KID, the latest versions of both should be filed with the Central Bank through the Portal.
