Continuing Obligation to Comply

Regulated Firms have a continuing obligation to comply with Fitness and Probity requirements under the Central Bank Reform Act 2010. Regulated Firms are responsible for ensuring that individuals performing CFs meet the F&P Standards, both prior to appointment and on an on-going basis, and for certifying same.

Due diligence should be carried out prior to Fitness and Probity Certification and any material changes should be notified to the Central Bank.  Regulated firms should investigate any concerns and take appropriate action without delay.

PCF Annual Confirmation and CF Certification

As part of the continuing obligations in relation to fitness and probity, the Central Bank requires Regulated Firms to complete an Annual PCF Confirmation and CF Certification.

This submission is required annually in respect of each active CF and PCF holder within the Firm, confirming they are compliant with the Fitness and Probity Standards and continue to agree to abide by those Standards.

The Annual PCF Confirmation and CF Certification must be submitted through the Central Bank of Ireland’s Portal.

Temporary Officers

Firms should have adequate succession/contingency plans in place for all of their PCF roles. However, a "Temporary Officer" may perform a PCF function on a temporary basis subject to Central Bank agreement in advance.

Maintain up to date PCF Holder Information

Regulated Firms are required to submit the following updates/changes for individuals approved to perform PCF roles through the Central Bank Portal:

  • An effective start date;
  • Notification where the approved individual is not taking up the role;
  • Change of residential address;
  • Change in contact details; and
  • Resignation.
